Arkansas' highest court says it won't review the driving while intoxicated conviction of a Little Rock lawyer who ran unsuccessfully for the U.S. House two years ago.
The Arkansas Supreme Court on Thursday denied Herb Rule's petition for review over his 2013 conviction by a Fayetteville District Court. Rule was arrested Aug. 9, 2012, while driving in Fayetteville.
Rule was the Democratic nominee for the 2nd Congressional District in 2012 and lost to Republican U.S. Rep. Tim Griffin. The day after his arrest, Rule said he'd had one ounce of Scotch two hours before driving, after having dinner with friends and supporters in northwest Arkansas.
The state Court of Appeals upheld his conviction in June. Rule argued the field sobriety test shouldn't have been used as evidence in his case.
