Prosecutors: Ex-Arkansas Judge Violated Plea Agreement

Federal prosecutors say a former Arkansas circuit judge who wants to withdraw his guilty plea to a bribery charge had violated the terms of his plea agreement about a month before asking to enter a new plea.

A motion to withdraw the plea of former Judge Michael Maggio says there is no evidence the bribe involved government business as required under the charge, that the U.S. attorney threatened to prosecute his wife and said the case should be dismissed.

Prosecutors filed a response Friday saying Maggio violated his plea agreement by failing to truthfully disclose all information and knowledge about the conduct of two other people implicated in the bribery, failed to be available for interview with prosecutors and he stopped cooperating with prosecutors.

Maggio is scheduled to be sentenced Friday.
